ORDER

Instances have come to notice where it has not been possible for the parent or guardian of a child or ward to mention the date of birth of the child in the application for admission or to file an affidavit to this effect or the child has not studied in a recognized school. May be in some cases the parent or guardian is not aware of the date of birth of the child. Accordingly, an amendment to Delhi School Education Rules, 1973 has been proposed by insertion of the following rule:

Rule 141 (A) Procedure of Admission of destitute and abandoned children

In case of a child where the affidavits required under sub-rule (2) of rule 135 and sub-rule (1) of rule 141 cannot, in the opinion of the head of school where admission is desired, be filed by the parent or guardian of such child, the head of the school shall refer the child to the nearest civil hospital having the facilities of determination of age, for determination of the period during which the child, according to the medical report which shall form part of the school records, could have been born and the mid-point of such period shall be recorded in the school records as the date of birth of the child and such child may be admitted by following the procedure prescribed in sub-rule (2) of rule 141."

The above amendment is pending consideration of the Government. Until such time the amendment is made, Dy. Directors of Education (District ) are directed to grant provisional admission to any such child approaching them or a school within their respective jurisdiction, to such class as the child may be eligible for, as per the provision of rule 141 (2) of Delhi School Education Rules, 1973.

These directions may be circulated to all the Education Officers and heads of school in the district and they be directed to take immediate necessary action for compliance.
