The following Act of Parliament received the assent of the president on the 1st January, 1996, and is hereby published for general information:

THE PEOPLE WITH DISABILITES (EQUAL OPPORTUNITES, PROTECTION OF RIGHTS AND FULL PARTICIPTION) ACT, 1995

No.1 of 1996

(1st January 1996)

An Act to give effect to the proclamation on the Full Participation and equality of the People with Disabilities in the Asian and Pacific Region.

WHEREAS the meeting to launch the Asian and Pacific decade of Disabled Persons 1993-2002 convened by the Economic and Social Commission for Asia and Pacific held in Beijing on 1st to 5th December, 1992, adopted the Proclamation on the Full participation and Equality of people with Disabilities in the Asian and Pacific Region.

AND WHEREAS India is a signatory to the said Proclamation;

AND WHEREAS it is considered necessary to implement the proclamation aforesaid.

CHAPTER VIII

NON-DISCRIMINATION

  1. Establishments in the transport sectors shall, within the limits of their economic capacity and development for the benefit of persons with disabilities, take special measures to:
    1. Adapt rail compartments, buses, vessels and aircraft in such a way as to permit easy access to such persons;
    2. Adapt toilets in rail compartments, vessels, aircraft and waiting rooms in such a way as to permit the wheelchair users to use tem conveniently.
  2. The appropriate Government and the local authorities shall, within the limits of their economic capacity and development, provide for:
    1. Installation of auditory signals at red lights in the public roads for the benefit of persons with visually handicap;
    2. Causing curb cuts and slopes to be made in pavements for the easy access of wheel chair users;
    3. Engraving on the surface of the zebra crossing for the blind or for persons with low vision;
    4. Engraving on the edge of railway platforms for the blind or for persons with low vision;
    5. Devising appropriate symbols of disability;
    6. Warning signals at appropriate places.
  3. The appropriate Government and the local authorities shall, within the limits of their economic capacity and development, provide for:
    1. Ramps in public buildings;
    2. Adaptation of toilets for wheel chair users;
    3. Braille symbols and auditory signals in elevators or lifts;
    4. Ramps in hospitals, primary health centres and other medical care and rehabilitation institutions.

How accessible is our country for its disabled citizens?

How accessible is education, training, employment, rehabilitation services, recreation, and medical treatment for that matter.

The seemingly simple acts of reaching the office, boarding the bus, going to the shop to buy a shirt, going to a cinema hall to see a movie, filing a complaint at the police station, dialing the phone to know the timings of a train, taking your body weight on the machine, going to the post office or bank, entering a school or college, can all be very taxing and even humiliating for people with various types of disabilities, The nature of challenges may vary for persons with physical, visual or hearing impairments, but the problem is the same- inaccessibility, insensitivity, discrimination - leading to what else but isolation!

The Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act was passed by the Indian Parliament in 1995. The Act mandates non-discrimination in transportation and in the built environment. Even after more than five years since the passing of the Act, nothing much has changed for the millions of disabled citizens living in the city. Five years is a long time for any agency to implement the law! The ……state organizations name…… therefore, plans to conduct a Disability Audit of select public buildings in Delhi to see how accessible they are for persons with disabilities.

We have the law to support us. Now, a process has to begin to assess the problem and take firm action towards making a disabled- friendly built environment. The objective of conducting a Disability Audit in Delhi is to identify the extent of the problem regarding access to public buildings in the capital city of India for persons with different disabilities and to create awareness on the issue.

A few public buildings/places will be identified for the purpose of the Disability Audit. Initially, a notice will be issued to the concerned authorities incharge of the place and the date of the Audit will be given.

A group of disabled activists representing various disabilities will go to these places to inspect them as to how disabled friendly they are (or not). The Audit Team will consist of about 10 to 12 people with visual impairment,. Orthopaedic disability, hearing and mental impairment. After the completion of each Audit, the Team will compile its observations in terms of problem areas and send its recommendations to the concerned authorities. A pragmatic deadline will be given to the authorities for compliance.

DISABILITY AUDIT IN DELHI

INDRAPRASTHA APOLLO HOSPITAL

Observations:

Indraprastha Apollo Hospital is one of the largest and the most recently built hospital in New Delhi, the capital city of India.

Before the Disability Audit, a letter was written to the Indraprastha Apollo Hospital, seeking their permission to conduct the Audit, so that the authorities were aware of it and minimum inconvenience was caused to the patients in the Hospital. The Hospital gave an immediate positive response.

All the members of the Disability Audit Team reached the Hospital on 30th May 2001 and were welcomed by the staff of the Hospital. Members of the print as well as visual media were also present due to the media mobilization done by the DPI-India Team during the previous two days.

The Audit Team visited the following areas of the hospital:

  • The main reception area
  • The sample collection area
  • One ward
  • One Out Patient Department
  • On Examination Room with the examination table and weighing machine, etc.
  • A few toilets in the hospital complex

Some of the main observations of the Audit Team were:

  1. There were no preferential parking areas specified for disabled people
  2. The information counters were high and not accessible for persons using wheel chairs
  3. There were no provisions for persons with visual impairment for usage of telephones, lifts and all pathways
  4. None of the toilet in the hospital were accessible, including the ones in the specimen room
  5. The doctor's examination tables were high and not reachable for a wheelchair user
  6. There was no weighing machine for taking the weight of a person who is unable to stand
  7. The water coolers were at a height where they were inaccessible
  8. The height of the beds in the wards were not adjustable
  9. The flooring was not slip resistant
  10. For persons with speech and hearing impairment, there were no sign language interpreters

However, all the floors of the hospital are accessible through ramps, stairs and lifts and the lifts and corridors are wide and spacious. The Team was of the opinion that most hospitals in India have similar barriers.

Immediate Impact:

The Disability Audit was followed by a meeting with the Managing Director of Indraprastha Apollo Hospital, Mr Y Mehrotra. He was very candid in accepting their lack of awareness and assured the DPI-India Team that the hospital will be made disabled friendly to a great extent in a time bound manner. He also assured that the information will be passed on to the concerned people so that the future architectural plans of the Apollo chain of hospitals incorporates these suggestions and the provisions of The Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 are implemented, both in letter and spirit.

The print and the visual media covered the Disability Audit and helped in raising awareness on the issue. Some of the press clippings are enclosed.
